2020 CDL Training — Terms and Conditions

Welcome to 2020 CDL Training. By accessing or using the website 2020cdltraining.com (the “Site”) and any services, content, or features made available through the Site (collectively, the “Services”), you agree to be bound by these Terms and Conditions (the “Terms”). If you do not agree to all of these Terms, do not use the Site or the Services.
“2020 CDL Training,” “we,” “our,” and “us” refer to 2020 CDL Training and its affiliates.
1. Eligibility and Acceptance
You must be at least 18 years old and have the legal capacity to enter into these Terms. If you are under the age of majority, you may use the Services only with the involvement, supervision, and consent of a parent or legal guardian, who agrees to these Terms on your behalf.
2. License and Intellectual Property
All content on the Site—including text, graphics, logos, course materials, videos, and software—is owned by 2020 CDL Training or its licensors and protected by copyright, trademark, and other laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, revocable, non-transferable license to access and use the Site and its content for your personal, non-commercial use.
Except as expressly permitted, you may not reproduce, distribute, modify, create derivative works of, publicly perform or display, or otherwise exploit any content from the Site without our prior written consent. No right, title, or interest in or to the Site or any content is transferred to you under these Terms.
3. User Submissions
If you submit, upload, or otherwise provide content (e.g., feedback, comments, files) through the Services (“User Content”), you grant 2020 CDL Training a non-exclusive, perpetual, irrevocable, sublicensable, worldwide license to use, reproduce, adapt, publish, display, translate, distribute, and otherwise exploit such User Content in any media now known or later developed. You represent and warrant that you own or control all rights in and to your User Content and that your User Content does not violate any law or third-party rights. We may remove or modify User Content at our discretion.
4. Prohibited Conduct
You agree not to:
- violate any applicable law or regulation;
- interfere with, disrupt, or attempt to gain unauthorized access to the Site, Services, or related systems or networks;
- collect or harvest personal data of users without lawful basis and consent;
- use bots, scrapers, or automated means to access the Site or extract data without our permission;
- reverse engineer, decompile, or otherwise attempt to derive source code or non-public functionality of the Services;
- upload, post, or transmit content that is harmful, illegal, infringing, defamatory, harassing, hateful, obscene, or otherwise objectionable;
- use our content or trademarks for any commercial purpose without prior written consent.
Violations may result in suspension or termination of access and any other remedies available at law or in equity.
5. Disclaimers
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, 2020 CDL TRAINING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL) ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY IS FOUND, THE TOTAL LIABILITY OF 2020 CDL TRAINING FOR ALL CLAIMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID (IF ANY) FOR THE APPLICABLE SERVICES IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, WHICHEVER IS GREATER.
7. Indemnification
You agree to defend, indemnify, and hold harmless 2020 CDL Training and its affiliates, officers, agents, and employees from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site or Services; (b) your violation of these Terms; or (c) your User Content.
8. Modifications and Termination
We may modify, update, suspend, or discontinue the Site, the Services, or these Terms at any time, with or without notice, to the extent permitted by law. Your continued use of the Site or Services following any changes constitutes your acceptance of the revised Terms. We may suspend or terminate your access at our sole discretion, without liability to you.
9. Governing Law and Jurisdiction
These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-law principles. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Virginia for any dispute arising out of or relating to these Terms or the Services.
10. Severability and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect. These Terms constitute the entire agreement between you and 2020 CDL Training regarding the Services and supersede all prior or contemporaneous understandings.
